There is a lot of misinformation on the web about what to do if pulled over for a DUI. We’re here to put that to rest.
Find a safe place to pull over immediately, and always follow the rules of the road. Even though you’re likely nervous, using your turn signals to pull over slowly and in a controlled manner is important. Remember, the dashcam is already recording you.
Be polite, courteous, and succinct. Address the officer as ‘sir’ or ‘mam’ and do not give any more information than asked for. Your answers should be as short as possible. Never admit to wrongdoing or answer any potentially incriminating questions. But also don’t lie. Admitting to drinking, even if it was hours ago, is non-specific and leaves room for interpretation.
The officer may ask you to step out of your vehicle, and you must oblige, but you are NOT required to submit to a field sobriety test. You may respectfully say, “my lawyer has always told his clients to never submit to these tests, so based on his guidance I am respectfully declining”.
If you feel like you are over the limit, you may refuse to take a breathalyzer test at the scene. Be aware that this will result in a 1-year suspension of your license even if found innocent. You will be required by law to take a chemical test at the station, but you can choose between breath or blood sample. Breath tests can be more easily attacked in court due to their notorious inaccuracy.
